A. Unit Description: The Operator leases to the Occupant the storage space designated as Unit #[Unit Number] (approx. size: [e.g., 10' x 10']).B. Term: The lease term shall be Month-to-Month, beginning on [Start Date].C. Termination: Either party may terminate this agreement by giving at least [Number, e.g. 10 or 30] days' written notice prior to the end of the month.
A. Monthly Rent: $[Amount] plus GST (5%).B. Due Date: Rent is due on the 1st day of each month.C. Proration: Rent for the first partial month is $[Amount], due upon signing.D. Security Deposit: $[Amount] (Refundable upon vacancy, provided unit is clean, undamaged, and empty).E. Late Fees: If rent is not received by the [5th] day of the month, a late fee of $[Amount] will be charged.F. NSF Fee: A fee of $[Amount] will be charged for any returned cheques or declined payments.
The unit is to be used for the storage of personal property only. The Occupant agrees NOT to store:
A. Store at Own Risk: The Operator is not responsible for any loss or damage to the Occupant’s property caused by theft, fire, water, rodents, insects, temperature changes, or any other cause.B. Insurance: The Occupant acknowledges that the Operator does not provide insurance for the stored goods. The Occupant is solely responsible for obtaining insurance coverage for their property.
This section is governed by the Warehousemen’s Lien Act (Alberta).
A. General Lien: The Operator has a lien on all personal property stored in the unit for rent, labour, or other charges in relation to the goods.B. Default & Lock-out: If rent remains unpaid for [Number, e.g., 5] days, the Operator may deny access to the unit (overlock the door and disable gate code).C. Seizure and Sale: If rent remains unpaid, the Operator may enforce the lien by selling the goods at a public auction. 1. Notice of Intention to Sell: The Operator must provide the Occupant with a "Notice of Intention to Sell" via registered mail or personal delivery. 2. 21-Day Waiting Period: The sale cannot take place until at least 21 days after the notice is given. 3. Advertisement: The sale must be advertised in a local newspaper (or equivalent public notice) at least once a week for two consecutive weeks prior to the sale. 4. Proceeds: Proceeds from the sale will be used to pay the outstanding debt and auction costs. Any surplus will be paid to the Occupant or into the annual revenue fund of the Government of Alberta if the Occupant cannot be located.
Upon termination, the Occupant must remove all contents and the lock, and sweep the unit clean. Any items left behind will be considered abandoned. The Operator may dispose of abandoned items immediately and charge the Occupant for disposal fees.
The Operator collects personal information to manage the tenancy and enforce the lease. This information may be disclosed to credit bureaus, collection agencies, or Civil Enforcement Agencies in the event of default, in accordance with the Personal Information Protection Act (Alberta).
